HOW TO SETTLE YOUR CASE FOR POLICY LIMITS

What's new this week? One of our soft tissue personal injury cases settled for $100,000.00. Being proud of the results, I would like to tell you a little story about the case and how we achieved such a successful settlement.

One day in the beginning of last year, my client (let's call her Dianne), drove with two close friends of hers from Los Angeles to Sequoia and Kings Canyon National Park to enjoy a little vacation camping amongst some of the most scenic landscape on Earth. Friends were planning that trip for over a year in advance. Ten minutes before reaching their final destination, they were T-boned by a car that ran a red light. And that put an end to their joyful plans.

Initially Dianne tried to personally work with the responsible insurance company believing that fairness would prevail. After months and months of frustrating attempts, going through a painful recovery, loss of a job, depression and an unpleasant medical prognosis, the insurance offered her nothing. They actually told her that her claims had no merit and she didn't really have a case that was worth anything...

I wonder if they actually looked at the case or simply brushed her off hoping that she would quietly go away?! It was time to make changes. When I spoke with Dianne at the time, the woman was completely crushed and emotionally devastated. I went through her story and had a strong gut feeling that the insurance was in the wrong. This woman was seriously injured, had residuals, a bunch of expenses, and needed provisions for future care. The insurance completely ignored its responsibility!

Having minimal knowledge of the claim details, Bausch Law Group held an office meeting strategizing on how best to steer this case in order to give it a new lease of life. • Don't underestimate the importance of having all the pertinent information properly organized.

• Don't give in to frustration and exasperation.

• Know your case from the inside out.
•  
• Be ready to fight any possible defenses the insurance may through at you.
•  
• Be sure you are fully aware of the extent of your injuries. Some symptoms may not appear until weeks, even months after an accident.
•  
• The insurance company will enter a settlement agreement only if it's in the company's best interest to do so. Thus, you have to be pretty convincing and be willing to litigate!

REMEMBER, you have only one shot at it, if you enter into a quick settlement with the insurance, and then later discover that you were cheated or need more medical treatment for your injuries, you cannot go back and ask for additional compensation.
